Website Terms and Conditions
Effective date: 16 September 2026
1. About these terms
These terms govern your use of this website. By using the website, you agree to them. If you instruct Theocsbury Estate Planning Ltd ("we", "us" or "our") to provide services, a separate engagement letter or terms of business will apply. If there is any conflict, the engagement letter or terms of business will prevail in relation to those services.
2. Website information and our services
The website provides general information about estate planning and our services, which may include wills, lasting powers of attorney, trusts, document storage, estate administration support and related planning. The exact scope of any service will be confirmed in writing before work begins.
Website content is not legal, tax, financial or investment advice and must not be relied upon as a substitute for advice tailored to your circumstances. Completing an enquiry form, sending us information or using a website tool does not by itself create a client relationship. We do not guarantee that any particular planning outcome, tax treatment or benefit will be available.
3. Quotations, fees and payment
Prices shown on the website are indicative unless expressly stated to be a binding quotation. Before accepting an instruction, we will explain the proposed work, the total price or basis of charging, whether VAT is included, foreseeable third-party charges and any key assumptions. Additional work or a material change in instructions may require a revised quotation, which we will discuss before proceeding.
Invoices are payable within 14 days by the methods stated on the invoice. We may pause work after giving reasonable notice if an undisputed invoice is overdue. Any interest or recovery costs will be charged only where lawful and clearly stated in the applicable engagement terms.
4. Forming a contract and providing services
A contract for professional services begins only when we confirm acceptance in writing or begin work at your express request. Any delivery date is an estimate unless agreed otherwise. We will perform services with reasonable care and skill and in accordance with the written scope of work. Delays caused by incomplete instructions, third parties, public bodies or events outside our reasonable control may extend the timetable.
5. Consumer cancellation rights
If you are a consumer and the contract is made at a distance or away from our business premises, you will normally have 14 days from the day after the contract is made to cancel without giving a reason, subject to applicable law and exceptions. To cancel, send a clear statement to the contact details above before the cancellation period expires. We will provide any legally required cancellation information and model cancellation form before the contract is made.
If you expressly ask us to begin during the cancellation period, you may have to pay a proportionate amount for work properly completed before cancellation. If the service is fully performed during that period following your express request and legally required acknowledgement, the right to cancel may be lost. These terms do not restrict any statutory rights.
6. Your responsibilities
- Provide complete, accurate and timely information, including relevant family, asset, liability, ownership, residence and existing-document details.
- Tell us promptly about material changes before documents are signed and review your planning after significant life or financial events.
- Read drafts carefully, ask questions and confirm that names, wishes and factual details are correct.
- Follow all signing, witnessing, registration, storage and implementation instructions. A document may be ineffective if formalities are not completed correctly.
- Do not alter a final document without obtaining appropriate advice.
- Obtain independent advice where we recommend it, including tax, financial, foreign-law or capacity advice.
7. Identity, capacity, conflicts and financial crime
We may request evidence of identity, address, authority, mental capacity, source of funds or other information where reasonably necessary. We may decline or stop acting where checks cannot be completed, instructions appear inconsistent with a client's free wishes, there is an unmanageable conflict of interest, or law or professional obligations require it. We may make disclosures to authorities where legally required and may be unable to tell you that we have done so.
8. Privacy, confidentiality and communications
We process personal information as described in our Privacy Notice and use cookies and similar technologies as described in our Cookie Notice. Those notices should explain what information is collected, the lawful bases for processing, recipients, retention periods, international transfers, security, individual rights and how to complain to the Information Commissioner's Office.
We will keep client information confidential except where disclosure is authorised, reasonably necessary to provide the agreed service, or required by law. Electronic communications cannot be guaranteed to be secure, uninterrupted or free from malware. You should verify any unexpected payment request using a trusted telephone number; we will not notify you of a change to bank details solely by email.
9. Document storage
If we offer storage of original documents, the arrangements, duration, fees, access rules, release procedure, succession arrangements and what happens if the business ceases trading will be set out separately in writing. You are responsible for keeping us informed of changes to your contact details and authorised representatives.
10. Intellectual property and acceptable use
Unless stated otherwise, we or our licensors own the website and its content. You may view and print reasonable extracts for personal, non-commercial use. You must not reproduce, sell, license, scrape, modify or exploit website content without permission, or use the website unlawfully, introduce malicious code, attempt unauthorised access, interfere with operation, impersonate another person or submit false or misleading information.
11. Website availability and third-party content
We may change, suspend or withdraw any part of the website without notice. We aim to keep information accurate and current but do not guarantee that it is complete, error-free or suitable for every purpose. References to third-party websites, products or services are provided for convenience and do not amount to endorsement; third parties control their own content and terms.
12. Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights. Subject to that, we are not liable for loss arising from reliance on general website information, matters outside our agreed scope, inaccurate or incomplete information supplied to us, failure to follow execution or implementation instructions, or events outside our reasonable control. Liability relating to professional services will be governed by the applicable engagement terms and any limitation must be fair, transparent and legally enforceable.
13. Ending an engagement
Either party may end an engagement in accordance with the applicable engagement terms. We may stop acting on reasonable notice, or immediately where legally or professionally necessary. You remain responsible for charges properly incurred and authorised third-party costs up to the end date. We will explain any material next steps or deadlines that we are aware of.
14. Complaints
If you are dissatisfied, please contact [name or role] at [email and postal address], describing the issue and the outcome you seek. We will acknowledge your complaint within [insert] working days and aim to provide a final response within [insert] weeks. A copy of our complaints procedure is available on request. If the matter is not resolved, you may be entitled to use [insert the correct professional body, approved ADR provider, ombudsman or other route, but only if applicable]. This does not affect your right to seek independent advice or use the courts.
15. Governing law and courts
These terms and any non-contractual dispute arising from them are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, except that a consumer resident elsewhere in the United Kingdom may usually bring proceedings in, and benefit from mandatory protections of, their home jurisdiction.
16. Changes and general provisions
We may update these terms from time to time by publishing a revised version and effective date. Changes do not retrospectively alter an existing service contract unless lawfully agreed. If any provision is found invalid or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver. No person other than you and us has a right to enforce these website terms, except where the law provides otherwise.
